Construction and Real Estate Litigation in Atlanta, GA
Our lawyers have significant experience handing sophisticated real estate litigation. We have represented owners, investors, developers, general contractors, subcontractors, management companies and investors in a wide variety of litigation involving construction defect litigation, enforcement of contractual obligations in real estate projects, financing disputes and workouts for distressed projects, ownership disputes involving partnerships and limited liability companies, disputes and regulatory issues related to environmental contamination, and insurance coverage disputes.
Representative cases handled by our attorneys at their current or former firms include:
- Successfully defended a limited partner in a limited liability partnership against veil piercing and alter ego claims seeking to hold the limited partner personally liable for a multi-million dollar judgment entered against a subsidiary of the LLP. Successfully obtained summary judgment on all claims brought against the client in the U.S. District Court for the Northern District of Georgia.
- When a bank wrongfully foreclosed on a valuable tract of commercial property on Peachtree Street in Midtown Atlanta without giving notice to the owner, one of our lawyers filed suit against the bank. After hard fought litigation, the defendant bank presented a settlement package to the owner on the eve of trial worth over twelve million dollars, including return of the property to the client.
- One of our lawyers represented the owner of a tract of commercial property against their insurance company after the insurance company refused to provide coverage for environmental contamination of the property caused by the long term operation of a dry-cleaning business on the site, and ultimately obtained a successful (confidential) resolution for our client.
